Introduction

By using the Services offered through this Website, App or Arthur Pay you are bound by the terms and conditions as set out below. If you do not agree to be bound by these terms and conditions, you must not use or access our Services.

Our Privacy Policy will also apply to your use of the Services.

 

Key Definitions

Company“,“Arthur Online” (“us”, “we”, “our” and “ours”) means Arthur Online Limited, registered at International House, 24 Holborn Viaduct, London EC1A 2BN with company number 07912886.

“Property managers” means any person who manages the tenancy or property on behalf of a Property owner and has permission to use Arthur and its Services.

“Tenant or Occupier” (“you”) means any person named on the tenancy agreement or living in the property with the Property owner’s permission regardless of whether they are named on the tenancy agreement or similar documentation

“Property owner” means any person named as the owner or landlord of the property

“Contractors” means any third party business or person who is registered on the Website in order to quote or accept work posted by property managers.

“Users” means anyone making use of the Arthur Online Services.

“Services” means any procedure or service that is provided by Arthur Online to Tenants or Occupiers, which includes, but is not limited to: information, services and products provided through the Website, App or Arthur Pay.

“Website” means the website Arthuronline.co.uk and all the pages, content and sub-domains contained therein on both a mobile and web platforms.

“App” means the Arthur Online app that you can can download from the Apple App Store or Google Play Store or which your property manager has invited you to download.

“Arthur Pay” – means the virtual e-money service in partnership with Modulr FS Limited.

Overview

Arthur Online is a cloud based property management platform which communicates with Tenants and or Ocuppiers to enable them to  access their tenancy and or occupancy information, raise any issues, communicate with a property manager and make payments through Arthur Pay.

We do not guarantee that our Website or App, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Website or App for business and operational reasons.

Content

When using the Services you must not:

  • use it in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms, or act fraudulently or maliciously, for example, by seeking to bypass security features, hacking into, or inserting malicious code, such as viruses, or harmful data, into it or any operating system;
  • infringe our intellectual property rights or those of any third party in relation to their use of it, including by the submission of any material (to the extent that such use is not licensed by these terms);
  • transmit any material that is defamatory, offensive or otherwise objectionable in relation to the use of it;
  • use it in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and
  • collect or harvest any information or data from any Services or our systems or attempt to decipher any transmissions to or from the servers running any Services.

You understand that all postings, messages, text, files, images, photos, video, sounds, or other materials (“content”) posted on, transmitted through, or linked from Arthur Online, are the sole responsibility of the person from whom such content originated. You are entirely responsible for all content that you post, email or otherwise make available via the Services. Any content you upload to our Website will be considered non-confidential and non-proprietary.

You understand that Arthur Online does not control, and is not responsible for content made available through the Services. Furthermore, the Arthur Online Website and content available through the Services may contain links to other websites, which are completely independent of Arthur OnlineArthur Online makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any such website.

You understand that other than mandatory checks carried out under relevant money laundering regulations Arthur Online does not in any way ‘vet’ or approve property managers, tenants, Contractors or property owners, who are listed on the site. In particular, Arthur Online does not warrant that any person named on the website has appropriate insurance, skills, qualifications or authorisations to carry out any work or service.

You acknowledge that Arthur Online does not pre-screen or approve all content, but that Arthur Online shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any content that is available on the website or App for violating the letter or spirit of the terms or for any other reason.

Intellectual Property

Arthur Online owns all the intellectual property rights relating to the Website and App, including the designs, text, database, graphics and layouts, and you agree not use or copy any part thereof without our express permission.

The intellectual property rights on postings, messages, text, files, images, photos, video, sounds, or other materials (“content”) you upload to Arthur Online is retained by the copyright owner, and these are added to the site by you at your own risk. In doing so you are giving expressed and irrevocable permission for us to store, display and use the content.

We have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our Website constitutes a violation of their intellectual property rights, or of their right to privacy.

You are solely responsible for securing and backing up your content.

Viruses

We do not guarantee that our Website will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our Website. You should use your own virus protection software.

You must not misuse our Website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Website or App, the server on which our Website is stored or any server, computer or database connected to our Website. You must not attack our Website or App via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Services will cease immediately.

Dealings with third party organisations and individuals

Your interactions with third party organisations and/or individuals found on or through the Website and / or App and/ or Arthur Pay, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organisations and/or individuals.

You agree that Arthur Online shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. If there is a dispute between you on this Website, App or Arthur Pay and/ or between other Users and any third party, you understand and agree that Arthur Online is under no obligation to become involved.

In the event that you have a dispute with one or more other Users, you hereby release Arthur Online, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or our service

Failed & Disputed Payments

If you have a question/issue about a transaction on your bank, credit or debit card statement, you will need to refer it to your bank in the first instance and if they have been unable to assist you can contact us using the form available on our Contact us page. Proof that you have raised the issue with your bank in the first instance may be requested.

Arthur Online is not responsible for any loss or damage or costs you might incur due to any temporary or permanent failure of its Services.

Feedback for service providers

You  understand that we can limit or restrict your use of the Services if you elect to use any profanity, libellous behaviour, illegal activity, or any other form of abuse of the feedback function. If you continue with any profanity, libellous behaviour, illegal activity, or any other form of abuse when providing feedback Arthur Online reserves the right to ban you from all current and future Services.

Arthur Online performs a number of checks on feedback to ensure authenticity and may at our sole discretion remove any feedback that we cannot verify.

Limitations

You acknowledge that Arthur Online may establish limits concerning use of the Services including but not limited to the maximum number of days that content will be retained, the maximum number and size of postings, email messages, or other content that may be transmitted or stored by Arthur Online, and the frequency with which you may access the Services.

You agree that Arthur Online has no responsibility or liability for the deletion or failure to store any content maintained or transmitted by the Website. You also acknowledge that Arthur Online reserves the right at any time to modify or discontinue the Website (or any part thereof) with or without notice, and that Arthur Online shall not be liable to you or to any third party for any modification, suspension or discontinuance of any services.

You agree that we shall not be liable for any loss or damages arising from the provision (or non-provision) of any part of the Services, including loss of profit or consequential loss or damage.

Termination of service

You agree that Arthur Online , in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email address, or otherwise terminate or restrict your access to or use of the Services, immediately and without notice, and remove and discard any content within the Website, for any reason, including, without limitation, if Arthur Online believes that you have acted inconsistently with the letter or spirit of these terms.

Further, you agree that Arthur Online shall not be liable to you or any third-party for any termination or restriction of your access to the Services.

Further, you agree not to attempt to use the Services after said termination.

Changes

Arthur Online reserves the right to change or update these terms and conditions from time to time. As a User of the website, you are responsible for acknowledging any updates of these terms and conditions by visiting this section. Any significant changes in the terms and conditions will be followed by notification emails to all active Users.
